The services and transactions offered in “MoKouran” may include but are not limited to the following: -
The CEB reserves the right, in its absolute discretion, to amend its records accordingly without the Customer’s prior consent and terminate the Customer’s subscription to “MoKouran”
MoKouran shall be available on a 24/7 basis except when instructed otherwise on the App.
Whenever MoKouran is not available, no prior notification will be sent upon restoration of services.
All dates & times refer to dates and times prevailing in Mauritius.
The Customer acknowledges that:
The Customer shall not assign any of its rights or obligations in the present Agreement, in any circumstances whatsoever without the prior written consent of the CEB.
The CEB shall incur no liability whatsoever with respect to the performance and execution by the App, of any of such instruction, data and/or message thereof.
The CEB shall not incur any liability if it is unable to perform its obligations under this Agreement due directly or indirectly to the failure or breakdown of any machine, data processing system, transmission link or any medium of access to MoKouran
The Customer’s instructions are irrevocable and unconditional and cannot be altered, modified, amended, restrained or extended by the Customer.
The CEB shall not be liable in any circumstances whatsoever for any loss or damage that the Customer may suffer as a result of the possession, use, misuse, abuse or any form of manipulation of such software that may interfere with the functioning of MoKouran. Furthermore, the CEB shall not accept any responsibility in connection with the suitability, performance or security aspect of such software.
“MoKouran” gives the Registered User access to his account and it is therefore recommended that the Customer keeps his mobile device secure and log out from it if he is not using it.
The OTP shall, at all times, be sent to the mobile number rovided by the Customer during registration.
The Registered User shall nevertheless be liable to the CEB for any transaction effected through “MoKouran” by any other person who acquired possession of the Customer’s mobile device whether it is with or without the Customer’s consent.
If the Customer suspects that a third party knows his password or other security details, he must immediately change his Login Password or PIN or alternatively contact CEB for assistance. If the Customer fails to do so, he shall be liable for any unauthorized transactions effected on his account which are as a result of his security details becoming known to a third party.
The customer understands the confidential nature of the following: his Business Partner number, his NIC number and his CEB invoice Numbers. The CEB shall NOT be liable of misappropriation of any of these information by any 3rd party.
The Customer understands and agrees that in order to access “MoKouran” effectively he shall obtain by his own means and maintain the appropriate Hardware and software.
The Customer shall be solely liable for any expenses, loss or damage that the CEB or any third party may suffer as a result of the possession, use, misuse, abuse or any form of manipulation of MoKouran.
The Customer further formally and irrevocably agrees that the CEB shall not, under any circumstances whatsoever, be liable for any loss, damage, interruption, delay or non-performance arising out of:
MoKouran credentials, i.e. User ID, Login Password and PIN must always be kept secure.
Wherever applicable, If the Customer’s User ID and/or Login Password have become known to any third party, he shall immediately change his Login Password or PIN or alternatively contact the CEB.
The PIN shall be a four digit pin set by the Registered MoKouran User and this can be changed by the latter through the application.
The Registered User shall, in all circumstances, keep his PIN secret, and not impart it to any person whomsoever
In case of loss, theft or suspected theft of a Mobile phone, the CEB may further require the Registered User to report same to the Police and to supply to the CEB proof that such report has been made
The Registered User shall immediately report to the CEB any loss or theft of a mobile device, including any suspected abstraction by any third party whosoever.
Report of the loss, theft, suspected theft or abstraction of the mobile device, shall in no way affect any transaction effected prior thereto.
The use of third party software shall be governed by the provisions contained in the Copyright Act No. 12 of 1997 as may be amended from time to time
In certain jurisdictions outside the Republic of Mauritius, the use of “third party software” may be illegal. The responsibility to ascertain the legality of the use of “third party software” outside the territorial limits of the Republic of Mauritius shall rest solely upon the Customer
Either party shall be entitled to terminate this Agreement by giving 30 (thirty) days’ prior notice to the other
The CEB also reserves the right to cancel the service if the Customer has not logged in on “MoKouran” for a period of 12 consecutive months
However the CEB shall be entitled to terminate this Agreement immediately upon any breach of this Agreement by the Customer or when the Customer’s accounts are not maintained in such a manner to the full and complete satisfaction of the CEB.
By accepting to access “MoKouran” through the use of his PIN or User ID and his login password, the Customer binds himself formally and irrevocably to the Terms and Conditions herein contained.
This Agreement shall be governed by and construed in accordance with the Laws of the Republic of Mauritius and any dispute arising in connection with the interpretation and/or fulfillment of this Agreement shall be submitted to the exclusive jurisdiction of the competent Courts within the Republic of Mauritius
While the CEB endeavours to keep the information accurate and up to date, the CEB makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, adequacy and/or reliability with respect to the App or the information contained thereof. Any reliance you place on such information is therefore strictly at your own risk.
All information contained on this website does not bind the Central Electricity Board and the Central Electricity Board shall not be liable for any loss and/or damage whatsoever, whether direct/indirect or consequential, arising out of, or in connection with, the use of this App.
If you are not the bill payer for the mobile telephone or handheld device being used to access the Website or App, you will be assumed to have received permission from the bill payer for using the Website or App.
You should take active steps to secure your account from unauthorized access, such as setting unique, non-obvious account passwords.
In no event CEB will be liable for any direct or indirect losses or damages of any kind arising out of your use or access to the Website or App, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.
CEB is not liable for any damage or alteration to your equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation or use of the Website or App.
CEB shall in any case have no liability to you if events beyond its control, such as internet connection, prevent it from providing the service (force majeure).
Payment
1. Payment(s) effected are non-refundable except in very specific circumstances; in which case the complaint has to be lodged in CEB Offices, Curepipe or Ebene.
2. Any Payment Amount (subject to s3 below) can be made
3. Payments of more than Rs 3000 (per transaction) are not possible.
4. Multiple payment transactions are allowed.
5. Where a customer is liable for disconnection and if payments are made after midnight, the customer will still be liable for disconnection.
6. Where a customer is liable for surcharge and if payments are made after midnight, the customer will still be liable for surcharge.
